Please read these terms and conditions of use ("Terms", "Terms of Use") carefully before using the Website operated by the Company. By using the Website, the Client agrees to be bound by these Terms.

Definitions

This website (the "Website") is operated by PT Nila Anugerah Persada, a travel agency based in Indonesia (the “Company”).

The tour packages on the website (individually a “Tour” and collectively the “Tours”) are offered for customers (the “Client”) under the following Terms of Use. When making an inquiry or a reservation via the Company, the Client accepts and agrees to these Terms of Use and to the travel Conditions. For the purposes of these Terms, “Party” means any other person than the Client who travels in the tour with the Client.

The Company on the Website provides an online platform to gather travel information including the tour packages offered and availability of travel-related services, and to make legitimate bookings. In case of Holiday Tours, these Terms of Use may change and your continued use of this website is conditioned upon acceptance of the updated Terms of Use. By making a reservation through the Website, the Client enters into a direct, legally binding, contractual relationship with the Company. The Client must save and print these terms and conditions for future reference when making an inquiry or booking.

Price And Payments

The default currency on the website is the United States Dollar (USD). Payment through the payment gateway will be proceeded and charged in the United States Dollar. Prices in other currencies are indicative and subject to the exchange rate charged by your bank plus any transaction fee determined by the bank or other agency processing the transaction. This means the amount listed on your credit or debit card statement may be a different figure than the figure shown when making your reservations on this website. If you have any questions about these fees or any exchange rate applied to your booking, please contact your bank or credit card issuer.

Booking Fees & Final Payment Per Person

A reservation will be made upon reception of the confirmation email sent by the Company. Your bookings are subject to tour availability while the booking fee forms part of your final payment. The reservation is not effective until the required payment is received. Reservations can only be accepted from Clients aged 18 or over at the time of the reservation.

Balance or full payment must be made 3 days prior departure. Failure to comply with this may result in an automatic cancellation of your reservation. All bookings shall be made in United States Dollar (USD) based on the exchange rate on the date of transaction and foreign currency booking shall be converted to USD on the date of the transaction.

Service Fee

No service fee will be charged for self-service bookings made on the website. For add-on bookings (pick up, baggage, etc.), service fees are adjusted based on those listed on the Company’s website.

Name In Reservations

Reservations must be booked in the Client's name as it is displayed on the passport/ID. Name changes are not allowed. The Client will be asked for a passport or ID upon arrival. If the name on the reservations and passport/ID does not match, the Client requires to make a new reservation.

Confirmations

Confirmation of a booking includes essential elements such as the description of the service booked and price, which will be sent to the Client by email. If the Client does not receive a confirmation email after 24 hours of placing the booking, the Client should contact the Company’s customer support team.

It is expressly agreed that data stored in the information systems of the Company and/or shall constitute proof with respect to the bookings made by the Client. Data stored in computers or electronic media are valid proof, and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.

Cancellation & Amendment

Cancellation and/or amendment to reservations must be made directly with the Company.

Cancellation Of Tour By Company

The Company reserves the right to cancel the tour due to insufficient availability or uncontrollable factors that do not allow the conduct of a safe tour or the delivery of services as described in the itinerary, including acts of nature, war, transportation or other forms of strike, civil strike, pandemic, endemic, order from the Government and/or other countries, and other force majeure.

The Company shall recommend alternative tours preferably to the same destination or other similar tours to the Client. However, the tour schedule will be adapted to the weather on the day of the tour. Should the Client decide not to accept the alternative tour, the Company shall not refund the paid payment.

The Company and/or associated agents reserve the right to alter or modify with or without prior notice the itineraries, travel arrangements and hotel accommodation in any way necessary, or withdraw the services of an accompanying tour manager, due to circumstances over which the operators have no control.

Cancellation Of Tour By Client

In the event the Client decides to cancel the tour or travel booking, the booking fee paid by the Client shall not be returned by the Company. However, the Client can change to another tour arranged by the Company within 7 days prior to the travel. If the Client does not present at the departure of the trip, refunds shall not be made. We reserve the right to cancel your booking if payment is deemed to be suspicious by the bank or if full payment is not received in a timely fashion.

Amendment/ Change Of Booking

If after making the booking the Client wants to change the trip with respect to the date of travel, the destination, the place where the trip starts, the accommodation or the means of transport, the Client should contact the Customer Support Team for assistance.

Bookings can be changed if provided space is available. A change to the entire booking shall be considered as a cancellation and subject to cancellation charges. You may cancel your booking at any time. Cancellations must be made in writing to avoid any misunderstanding. No amendment may be made within 7 working days prior to the date of departure. A fee may be imposed by the Company’s travel associate in the event of a change to a booking. The Company’s administration fee will apply in addition to any fees imposed by the travel associate.

Refunds / Refund Of Unused Services

In the event of a refund due to cancellation or changes to the booking, refunds will only be due to the Client in line with the rules and restrictions of the Company as notified in the booking process.

No refund can be made in respect of accommodation, meals, sightseeing tours, transport or any other services, which are included in the tour fares and not utilized by the tour member. Refunds will only be made after the Company received the refunds amount from the travel associates. Customers should note that refunds from the travel associates may take up to 6 months. All refunds shall depend on the exchange rate at the point of refund. Upon receiving the refunds from travel associates, the amount (after deductions of administration fee) will be transferred back via the same payment mode of the original booking.

Administrative & Health Regulations

You are responsible for ensuring that you meet foreign entry requirements and that your travel documents, such as passports and visas (transit, business, tourist, and otherwise), are in order and any other foreign entry requirements are met. The Company has no special knowledge regarding foreign entry requirements or travel documents. The Company urges the Client to review travel prohibitions, warnings, announcements, and advisories issued by the relevant governments prior to booking travel to international destinations.

Health: Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. For medical advice regarding your journey, please contact your doctor.

Some overseas countries have an immigration requirement that a customer’s passport is valid for a minimum period after the Client enters that country, typically 6 months. If the Client’s passport is in its final year of validity, it is advised to confirm the requirements of the destination before making final travel plans. The name on the passport must match the name on the ticket, otherwise, the Client may not be able to travel and insurance may be invalid.

For information on visa requirements, it is advised to contact the embassy of the country they propose to visit.

Please note: It can often take some time to obtain a visa, it is advised to apply in advance. Requirements may change and the client should check for up-to-date information before booking and departure. The Company accepts no liability if the client is rejected to enter a flight or into any country due to the failure to carry the correct and adequate passport, visa, or other travel documents required by any airline, authority, or country, including countries the Client may just be transiting through. This includes all stops made by the aircraft, even if the Client does not leave the aircraft or airport.

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. The Company urges the Client to review any travel prohibitions, warnings, announcements and advisories issued by the government prior to booking travel to international destinations.

ACCOMMODATION STAR RATINGS

Star ratings are only a general guide. You should be aware that these are not necessarily the official local rating and that standards can vary between hotels and accommodation of the same class in different countries, and even in the same country. Different countries have different standards; a 3-star hotel in one country is not necessarily equivalent to a 3-star hotel in another.

USE OF ROOMS

Single rooms generally have one bed and a supplement is often payable for these rooms. Double rooms usually have either two single beds or one double bed.

TOUR IMAGES

Whilst the Company endeavors to ensure that tour images and descriptions of the trip and facilities displayed on the Website are an accurate and up to date representation of the tour, the Company cannot guarantee this always to be the case as we obtain this information from our travel associates.

TOUR ACTIVITIES

It is possible that, from time to time particular activities offered by the travel associates that are shown in the description of the Tours on the Website are canceled, for example as a result of weather conditions or other force majeure reasons, during out-of-season trips, or if the required number of participants for the activity is not achieved.

TOUR MEALS

If meals are part of a tour package, the number of meals depends on the tour offered. Full board normally includes breakfast, lunch and dinner. Half board normally includes breakfast and either lunch or dinner, depending on the package. The accommodation which includes main meals generally commence with dinner on the day of arrival at the hotel and terminate with breakfast (on half board) or lunch (on full board) on the day of departure. If one or more meals cannot be taken, no refunds will be made.

Clients with babies or kids with special meal restriction (e.g. food allergy) are advised to bring special food for the children with them, as this is not always available locally.

ACCOMMODATION TAXES

The local authorities in certain countries may impose additional taxes (tourist tax, etc), which generally have to be paid locally. The Customer is exclusively responsible for paying such additional taxes. The amount of taxes can change between booking and stay dates. In the event that taxes have increased as at your stay date, you will be liable to pay taxes at the new higher rate.

TRAVEL INSURANCE

The prices on the Website do not include travel insurance. The Client is therefore advised to prepare personal insurance that covers the consequences of certain cases of cancellation and that also provides cover for certain special risks such as the cost of repatriation in the event of an accident or illness. It is the Client’s responsibility to ensure any insurance policy taken out is adequate to cover their requirements.

Claims must be submitted directly to the insurance company in accordance with the terms and conditions of the policy.

TOUR INFORMATION & PRICES

Prices shown are correct at the time of publication information and the Price List forms part of the brochure and the Website. The prices are subject to change due to increase in exchange rates, other transport costs, hotel rates, government tax, etc, and therefore the Company reserves the right to increase prices accordingly without notice.

RIGHT TO REJECT

The Company reserves the right to cancel or withdraw any itinerary, or any bookings made for the Client or decline to accept or retain any person as a member of a tour. If any such person may appear likely to endanger the health, safety or impair the comfort and enjoyment of others on the tour. The Company further reserves the right to cancel this reservation.

RESPONSIBILITY

The Company and its associated agents such as car rentals, coach companies, accommodation companies’, entertainment and meal suppliers and other principals involved in this tour and/or service. act only as agents for the Client. All tickets, vouchers and documents under which such transportation and other services are provided.

Exclusion Of Liability Clause

The information, software, products and services provided by the Website may include typographical errors. Associated agents such as independent car rentals and other suppliers are independent and not employees of the Company. The Company shall not be liable for acts, errors, omissions, representations, warranties, breaches or negligence of any such persons or for any personal injuries, death, property damage or other damages or expenses resulting from acts or omissions occasioned by the aforesaid.

The Company shall make no refund or compensation in the event of any delay, cancellation, overbooking, strike, force majeure, pandemic, endemic or other causes beyond the direct control of the Company and shall have no responsibility for any additional expense, omissions, delays, re routing or acts of any Government or State authority. In no event shall the Company and/or the respective travel associates be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of contract or in tort whatsoever and however arising.

All claims against the Company must be made in writing within 30 days after the completion of the tour.

Disclaimer

The Company and its agents and representatives are not responsible and expressly exclude liability for any injury, illness, damage, loss, delay, accident or irregularities that may be caused to a person or property and all bookings are subject to the usual terms and conditions and contract of the owner or operator of the services involved. The transportation companies shall be exempted from all liability in respect of any detention, delay, loss, danger, sickness or injury caused and of whatever kind occurring to the Client at any time whilst the passengers are not on board a carrier of conveyance used or operated by transportation by the companies or firms. The company does not accept any liability in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by events which are beyond its control or which are not preventable by reasonable diligence on its part including but not limited to war, civil disturbances, fire, floods, unusually severe weather, acts of god, act of government or of any authorities, accidents to or failure of machinery or equipment or industrial action.

All claims against the company must be made in writing within 30 days after the completion of the tour. All disputes, if any, will be subject to the Indonesia Court of Law.

All terms and conditions mentioned above cannot be altered or waived and enquiries pertaining to this document may be made to the Company.

The Company shall advise and if needed, assist the Client with regards to any claims against any party in your tour. The Website shall ensure that the collection, use and disclosure of the Client’s personal data complies with the Personal Data Protection Act 2010 (‘PDPA’). It is acknowledged that personal data collected and processed is obtained voluntarily and with the Client’s consent.
